Earnest Money Deposit (EMD)
  1. The Earnest Money Deposit is required to protect the Purchaser's interests against the risk of bidder's conduct, which would warrant forfeiture of the bid security
  2. An Earnest Money Deposit (EMD) of Rs. 1,00,000/- as mentioned in NIT in the form of A/C payee Demand Draft drawn in favor of the " AO (Cash), O/o CCA Gujarat” payable at Ahmedabad from a nationalized/scheduled bank, shall be paid as directed in NIT.
  3. Amount or amounts payable, if any, to the bidder or the bid security furnished by the bidder in respect of an earlier bid, shall not be adjustable against this bid.
  4. The amount deposited as bid security shall carry no interest during the entire period it remains with Department of Telecommunications.
  5. The Earnest Money Deposit of the unsuccessful tenderer will be refunded without interest within reasonable time after final decision of the tender, normally within six months from the date of opening of tenders.
  6. The Earnest Money Deposit of the successful bidder will also be returned without interest within reasonable time after final decision of the tender, normally within six months from the date of opening of tenders
  7. The bid security (EMD) shall be forfeited: a. If the bidder withdraws his bid during the period of bid validity; or b. In the case of a successful bidder, if the bidder fails to sign the contract and/or fails to furnish performance guarantee (S.D.) in accordance to the relevant clauses of the documents(s).

  1. Bidder’s Detail duly filled (as per section VI).
  2. EMD (Scanned copy of DD to be uploaded online & Original DD to be submitted offline).
  3. Cost of the tender document i.e document fee (scanned copy of DD to be uploaded online & original DD to be submitted offline)
  4. Self attested copy of Certificate of Incorporation from Registrar of Companies in respect of clause 3(a) of Section II
  5. Self attested copy of Article/Memorandum of Association of the Company in respect of clause 3(a) of Section II
  6. Self attested copy of ISO 9001-2008 & 14001:2004 Certification in respect of Clause 3(c) of Section II
  7. Certificate from CA stating the Annual Turnover for last three Financial Years (i.e. FY 2013- 14, FY 2014-15, FY 2015-16) thereby validating an Annual turnover of Rs. 2 Crore for last three financial years in respect of Clause 3(d) of Section II
  8. Self attested copy of valid labour license of the Company
  9. Self attested copy of PAN/GIR card of the Company in respect of clause 3(h)
  10. Self attested copy of the Service tax registration of the Company in respect of clause 3(f)
  11. Self attested copy of the EPF Certificate of the Company in respect of clause 3(g)
  12. Self attested copy of the ESI Certificate of the Company in respect of clause 3(g).
  13. Self attested copy of experience certificates, work orders etc. establishing at least three years’ experience (during the last 5 years) of providing manpower services to CPSU, Nationalized Banks, Government Departments (State or Centre) etc. in respect of clause no. 3(b)
  14. Self attested copy of experience certificates establishing an experience of similar work with cost of at least Rs. 20,00,000/- at CPSU, Nationalized Banks, Government Departments (State or Centre) etc. in respect of clause no. 3(e).
  15. Declaration regarding no near relatives as per Section XV by all directors of company or Company Secretary
  16. Declaration regarding Blacklisting/Non-blacklisting (Section XII)
  17. Pre receipt for refund of EMD (Section XIII)
  18. Declaration regarding acceptance to terms and conditions of the tender (Section XIV)

Award of Contract
Department shall consider placement of letter of intent to the bidder whose offer has been found technically, commercially and financially acceptable.

Acceptance of Award
The bidder, within 10 days of issue of letter of intent, shall give his acceptance by executing the agreement as per the Section IX on a non-judicial stamp paper of Rs. 100/- the cost of which will be borne by the tenderer himself
Performance Security
  1. Earnest Money (5% of the estimated cost of work i.e. Rs. 1,00,000/- ) deposited at the time of submission of the tender will not be adjusted towards Security Deposit on the acceptance of the tender.
  2. The successful tenderer will have to deposit a Performance Security Deposit of 10% of contract value before the settlement of the bill of the first month of the contract. The performance security will be furnished in the form of the Bank Guarantee drawn in favour of ---------- payable at______. The performance security should remain valid for a period of 1 year and 3 months from the commencement of the contract.
  3. Security Deposit shall not bear any interest for any period whatsoever, and therefore, Interest shall not be payable by the DoT on the Security Deposit or on amounts payable to the Contractor under the contract.
  4. Security Deposit/PBG shall be liable for appropriation / adjustment against any liquidated damages for delayed execution. If the contractor fails or neglects to perform any of his obligations under the contract, it shall be lawful for the DoT to forfeit either whole or any part of the Security Deposit furnished by the contractor
  5. The Security Deposit/PBG shall be considered for adjustment against liquidated damages only at the time of final conclusion of the contract and final settlement of account.
  6. Security Deposit/PBG that is due for refund to the Contractor and remain unclaimed for One years after its refund becomes admissible (for instance, after the contractor fulfils his contract) shall be dealt with in accordance with the provisions contained in the rules of the DoT.
Termination of Contract
  1. In case of any default by the contractor in any of the terms and conditions, DoT may without prejudice to any other right/remedy which shall have accrued or shall accrue thereafter, terminate the contract, in whole or in part, by giving one week’s notice in writing to contractor/ bidder.
  2. All instructions, notices and communications etc. under the contract issued in writing and if sent to the last known place of business, shall be deemed to be served on the date, even in ordinary course of post, these would have been delivered to the contractor
  3. Notwithstanding anything contained herein, DoT also reserves the right to terminate the contract at any time or stage during the period of contract, by giving one week’s notice in writing without assigning any reason and without incurring any financial liability whatsoever to the contractor.

SECTION - VIII
PERFORMANCE SECURITY BOND FORM
In consideration of Dy. Director General, Telecom Enforcement, Resource & Monitoring Cell, having agreed to exempt __________________ (herein after called the said contractor(s)) from the demand of security deposit money of Rs.____________ on production of bank guarantee for Rs. _________ for the due fulfilment by the said contractors of the terms and conditions to be contained in an agreement in connection with the contract for supply of unskilled & semiskilled manpower , we, ( Name of the Bank) at the request of __________________ contractor's do hereby undertake to pay the DDG an amount of not exceeding Rs.________ against any loss or damage caused to or suffered or would be caused to or suffered by the DDG(TERM Ahmedabad) by reason of any breach by the said contractor of any of the terms and conditions contained in the said agreement.
 2. We (Name of the Bank) __________________________________ do hereby undertake to pay the amounts due and payable under this guarantee without any demur, merely on a demand from the DDG (TERM Ahmedabad) stating that the amount claimed is due by way of loss or damages caused to or suffered by the DDG (TERM Ahmedabad) by reason of breach by the said contractor of any of the terms and conditions contained in the said agreement or by reason of the contractor's failure to perform the said agreement. Any such demand made on the bank shall be conclusive as regards the amount due and payable by the bank under this guarantee where the decision of the DDG (TERM Ahmedabad) in these counts shall be final and binding on the bank. However our liability under this guarantee shall be restricted to an amount not exceeding Rs. ________ 
3. We undertake to pay to the DDG any money so demanded not withstanding any disputes raised by the contractor (s) / supplier(s) in any suit or proceedings pending before any court or tribunal relating to our liability under the present being absolute and equivocal. The payment so made by us under this bond shall be valid discharge of our liability for payment there under the contractor (s) / supplier (s) shall have no claim against us for making such payment. 
4. We (Name of the Bank)_______________________________ further agree that the guarantee herein contained shall remain in full force and effect immediately for a period of one year and three months from the date herein and further agrees to extend the same from time to time (after fifteen months) so that it shall continue to be enforceable till all the dues of the DDG______________ under or by virtue of the said agreement have been fully paid and its claims satisfied or discharged or till DDG certifies that the terms and conditions of the said agreement have been fully and properly carried out by the said contractor (s) and accordingly discharges this guarantee.  5. We (Name of the Bank), further agree with DDG (TERM Ahmedabad) that DDG (TERM Ahmedabad) shall have the fullest liberty without our consent and without effecting in any manner our obligations hereunder to very and of the terms and conditions of the said agreement or to extend time of performance by the said contractor (s) from time to time or to postpone for any time to time any of the powers exercisable by the DDG (TERM Ahmedabad) against the said contractor (s) and to forbear or enforce any of the terms and conditions relating to the said agreement and we shall not be relieved from our liability by reason of any such variation, or extension being granted to the said contractors or any indulgence by the forbearance, or any omission on the part of the TERM Ahmedabad or any in indulgence by the DDG(TERM Ahmedabad) to the said contractors or by any such matter or thing whatsoever which under the law relating to sureties would, but for this provision, have effect of so relieving us.
 6. This guarantee will not be discharged due t

o the change in the constitution of the Bank or the contractor (s) / supplier (s). 
7. This guarantee shall be irrevocable and the obligations of the Bank herein shall not be conditional to any prior notice by DDG.
